Definitions

  • “Company” means Gestion Exotics Inc., a vehicle management and client referral company operating as Luxury Car Rental Montreal.
  • “Renter” means the individual named on the rental contract.
  • “Vehicle” means the automobile/SUV/boat rented, including keys, accessories, and documented condition.
  • “Rental Period” means the period from pickup date and time to return date and time.
  • “Declared Vehicle Value” means the agreed value of the Vehicle as stated on the rental contract, used as reference for damage and total loss calculations.
  • “Deposit” means a partial security guarantee collected at the start of the rental. The deposit does not represent the maximum liability of the Renter, who remains responsible for all amounts exceeding the deposit.

Rental Requirements

  • • Minimum age 18. A $50/day Young Driver Fee applies for renters aged 18–24.
  • • Valid driver's license required at pickup.
  • • Proof of full comprehensive insurance at replacement value is mandatory. Written confirmation from the insurer or broker is required, covering: named driver, exact vehicle, VIN, rental dates, collision, fire, theft, vandalism, sufficient value, and commercial rental/loaner coverage for Quebec/Ontario territory.
  • • Security deposit of $1,500–$10,000 CAD, authorized on credit card. The deposit is a partial guarantee only — the Renter remains responsible for all amounts exceeding the deposit.
  • • Deposit refunded upon return of the vehicle in the same condition, subject to inspection. The entire deposit may be applied toward repair costs and lost rental days.
  • • Pictures of the Renter's driver's license and insurance card are retained for 90 days after return.

Rental Period & Return

  • • Minimum 1 day (24 hours). Multi-day packages available.
  • • Late return exceeding 30 minutes = additional half-day charge. Exceeding 2 hours = full day charge.
  • • Early returns: no pro-rated refund.
  • • Return to agreed location only unless arranged in advance.
  • • Fuel must be returned at the same level as provided (full).

Vehicle Use & Prohibited Activities

  • • The vehicle may only be driven by the Renter or an authorized additional driver named on the contract.
  • • The vehicle must not be used for: racing, track days, stunt driving, off-road use, or any illegal activity.
  • • The vehicle must not be driven under the influence of alcohol, drugs, or any substance impairing judgment or reaction time.
  • • Smoking, vaping, and pets are strictly prohibited inside the vehicle. A cleaning fee of $500 minimum applies.
  • • The vehicle must not be driven outside the province of Quebec without prior written consent. Travel to the United States requires explicit written approval.
  • • The vehicle must not be used as a prop in any media production without a separate written agreement.
  • • Towing of any kind is prohibited.
  • • Exceeding 150 km/h is a material breach of this Agreement and may result in immediate rental termination, vehicle repossession, and application of the security deposit toward documented losses, fees, towing, administrative costs, and damages caused by the breach.

Damage & Liability

  • • The Renter is responsible for all actual, documented damage occurring during the Rental Period, except to the extent caused by the Company's gross fault, intentional fault, or a pre-existing mechanical defect not caused by the Renter.
  • • In the event of damage, the Renter is responsible for: insurance deductible, any balance not covered by insurance, towing/storage/appraisal costs, proven loss of use, diminution of value if applicable, reasonable legal and collection fees to the extent permitted by law, and any gap between insurance payout and the greater of the Declared Vehicle Value or fair market value immediately before the incident.
  • • The Renter does not pay twice. Any salvage value, recovered vehicle value, insurance payment, third-party payment, or other recovery shall be credited against the Renter's obligation.
  • • Pre-rental inspection (timestamped photos/video) versus post-return inspection determines new damage.
  • • Interior damage (stains, burns, scratches) at full repair cost.
  • • Must notify the Company and police immediately of any incident.

Total Loss / Theft

  • • A Total Loss occurs when the Vehicle is stolen and not recovered, destroyed, declared a total loss by an insurer, or damaged to the extent that repair is not economically reasonable based on the Vehicle's market value, declared value, or insurer assessment.
  • • In the event of total loss, theft, fire, vandalism, or major damage, the Renter is responsible for all amounts not covered by insurance, including: deductible, towing, storage, appraisal, proven loss of use, diminution of value, and any gap between insurance payout and the greater of the Declared Vehicle Value or fair market value.
  • • The Renter never pays twice. All salvage value, recovered vehicle value, insurance payments, and third-party payments are credited against the Renter's obligation.
  • • A Total Loss Addendum must be initialed separately by the Renter.

Loss of Use

  • • Loss of use is calculated as: daily rental rate × actual days the Vehicle is unavailable, capped at 30 days, subject to proof of cancelled bookings or reasonably documented repair/replacement downtime.
  • • Loss of use beyond 30 days requires documented evidence of confirmed reservations or an extended repair timeline.

Insurance

  • • The Renter must carry full comprehensive insurance at replacement value.
  • • Written confirmation from the insurer or broker is required at pickup (see §2 for details).
  • • The Company does not provide insurance. No Collision Damage Waiver (CDW) is offered.
  • • If the Renter's insurance denies a claim, the Renter remains personally liable for documented actual damages.

Mileage

  • • 200 km included per day.
  • • Multi-day rentals: 200 km/day cumulative.
  • • Excess: $2/km (standard vehicles), $5/km (supercars).
  • • Unlimited mileage available on select multi-day packages.

Delivery & Pickup

  • • Free delivery in Greater Montreal (downtown, Westmount, Laval, South Shore).
  • • YUL airport delivery available 24/7.
  • • Outside Greater Montreal: distance-based fee applies.
  • • The Renter must be present at delivery and pickup for sign-off.

Cancellation

  • • Cancellations made more than 48 hours before pickup receive a full refund of any deposit paid.
  • • Cancellations within 24–48 hours of pickup are subject to a 50% charge of the total rental cost.
  • • Cancellations within 24 hours of pickup, or no-shows, are charged 100% of the total rental cost.
  • • Weather-related cancellations follow the same rules as above.

Vehicle Ownership & Third-Party Operators

  • • Gestion Exotics Inc. is a vehicle management and client referral company. The Company manages rentals and connects clients with vehicle owners.
  • • Vehicles offered for rental may not be owned by Gestion Exotics Inc. and may be provided by third-party vehicle owners.
  • • The Company acts as an intermediary between the Renter and the vehicle owner. All rental terms, insurance requirements, and liability provisions apply equally regardless of vehicle ownership.
  • • For third-party vehicles, an Owner Authorization Addendum confirms that Gestion Exotics Inc. has been authorized by the owner to rent the Vehicle, collect the deposit, manage claims and damage recovery, communicate with insurers, pursue the Renter for unpaid damages, and receive insurance payments or compensation on the owner's behalf.

Indemnification & Release of Liability

  • • The Renter agrees to indemnify, defend, and hold harmless the Company, its owners, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including legal fees) arising out of or related to the Renter's use of the Vehicle during the Rental Period.
  • • The Company is not liable for any indirect, incidental, or consequential damages, including loss of income, loss of use, or inconvenience.

Privacy & Personal Information

  • • Personal information is collected solely for rental processing and verification.
  • • Pictures of the Renter's driver's license and insurance card are retained for 90 days after return.
  • • No personal information is sold or shared with third parties for marketing purposes.
  • • SMS is used only for booking confirmations, reminders, and rental updates. Reply STOP to opt out.

GPS & Vehicle Monitoring

  • • All vehicles are equipped with GPS tracking and telematics. The Company monitors location, speed, and operating conditions in real time.
  • • Tampering with, disabling, or removing tracking devices is strictly prohibited and results in immediate rental termination and forfeiture of the full security deposit.

Governing Law

  • • This agreement is governed by the laws of the Province of Quebec and applicable federal laws of Canada. Disputes shall be resolved in the courts of Quebec, District of Montreal.

Entire Agreement

  • • This agreement, together with any signed addenda, constitutes the entire agreement between the Company and the Renter. No oral representations override these terms. Amendments must be in writing and signed by both parties.
